The proposed move of Ivory Coast forward Yan Diomande from RB Leipzig to Real Madrid will not be blocked by a legal dispute between two agencies claiming the right to represent him, according to legal sources close to FIFA.
The disagreement has emerged two weeks after Real Madrid publicly declared their interest in the 23-year-old, raising concerns over whether the dispute could delay or prevent the transfer.
However, the sources told Spanish newspaper Mundo Deportivo that FIFA has no authority to intervene in arguments over agents’ commissions. Such matters must be settled directly between the parties involved, they said, and will have no bearing on Diomande’s ability to join Real Madrid.
The transfer is expected to be completed once the German club registers the player internationally. Real Madrid can then finish the process required for Diomande to receive permission to play for them.
According to the same sources, FIFA’s regulations are clear: players must be allowed to exercise their right to move clubs without obstruction. Any disagreement over representation or commission is treated separately from the player’s sporting right to transfer.
The sources also referred to FIFA’s position in the former case involving French midfielder Lassana Diarra, saying it reinforced the principle that has guided the organisation’s regulations for several years. That approach is intended to provide players with legal protection when disputes between agents or clubs arise.
They went further by claiming that, even if Diomande chose to terminate his contract with RB Leipzig unilaterally, FIFA would immediately grant him the right to move to Madrid and play in the Spanish capital.
Any compensation Diomande might then be required to pay RB Leipzig for ending the contract would be considered a separate issue from his right to register and play for Real Madrid, the sources said.
Dispute over representation
The dispute centres on Max Gradell and his company Maxedil Management, which oversaw Diomande’s move from Spanish club Leganes to RB Leipzig a year ago.
Maxedil Management has since been challenged by Roc Nation, the agency currently managing Diomande and also representing Brazilian forward Vinicius Junior.
People familiar with the matter say Maxedil has filed a complaint with FIFA, alleging a breach of contract. The company’s case is understood to be based on the claim that RB Leipzig negotiated with Roc Nation without first consulting Maxedil.
That dispute has created a complicated legal backdrop to a transfer which had otherwise been developing as a major deal in the summer market.
Diomande has established himself as one of the most highly rated emerging players in European football after an outstanding season with RB Leipzig in the Bundesliga. His performances have made him a leading target for Real Madrid as they look to strengthen their attack and compensate for the departures of some of their established players.
Despite the disagreement between the agencies, the move is expected to go ahead in the coming days. The legal sources’ interpretation of FIFA’s rules suggests the conflict over representation should not interfere with Diomande’s registration or his prospective move to Real Madrid.
The case has nevertheless become one of the most closely watched issues of the current summer transfer window because it involves a high-profile player, two competing agencies and a potential transfer to the Spanish club.
